Working off the Clock

Is your employer paying you all you earn?    Many employers try to squeeze extra time out of you without paying for it.  They do this in different ways:

  • Your employer asks you to clock out, but stay until the job is finished.
  • Your employer “manages” your time clock; telling you, “give me your card, I’ll take care of it”.
  • Your employer makes you show up 15 minute early, but doesn’t start the clock until the top of the hour.

The problem is, you are putting in time for your employer’s benefit, and he isn’t paying you for your time.

Working off the Clock is illegal! Your employer should pay you for the time you are working for him, including necessary “standby” time;   time when you have to be available and cannot go out and do things that you want to do.  The law requires it.  The law is on your side.

For Example, Your employer requires you to show up early for mandatory meetings once a week, but doesn’t pay you for that time.   Your employer is obligated to include that time in your pay calculations and to pay you for that time.  If that makes the actual work day, including the time for the meeting, exceed 8.0 hours, then your employer owes you overtime for the rest of it.
