“You’ve come a long way, baby.”

You've Come a Long Way Baby!In 1968 the Phillip Morris Companies coined that advertising slogan to sell Virginia Slims cigarettes to young professional women. Advertising aside, women have clearly and legally become equals to men in all segments of society, including the workplace. It is clearly understood, to most people these days, that considering women are serving in the armed forces, working as police officers, and filling the role of construction workers and other traditionally “male jobs,” that women have equal skills and talents as men. Yet, despite this advancement and general acceptance, workplace gender discrimination on the basis of sex is still more commonplace that is should be considering that it is ILLEGAL in the eyes of federal and state law.

What is Gender Discrimination

The fundamental premise of gender discrimination is the unequal and unfair treatment of a person because of a person’s gender or sex. If there is different treatment afforded men and women, that may not, in itself, constitute gender discrimination. For gender discrimination to be illegal, the treatment afforded one gender over the other gender must be unequal, and as a result of being unequal, be unfair. For example, providing separate washrooms for men and women does not constitute gender discrimination, whereas differences in hiring, pay scales, benefits, promotions, advancements, and work conditions, made on the basis of a person’s sex may rise to illegal and unfair gender discrimination in the workplace.

Gender Discrimination is usually an Issue for Women

Gender discrimination affecting women still continues to exist in many workplaces, resulting in an unfair or discriminatory approach towards women in the employment sector. Such discrimination may result in women receiving lesser job opportunities, lesser chances of career advancement, and lower pay compared to men with similar qualifications, skills and ability. In less common circumstances, men too may be subjected to gender discrimination.

Even in organizations where it may seem as if there is no discrimination, if you look more closely you might uncover evidence that there are subtle efforts to keep women’s salaries lower and employment opportunities fewer than those available for a man of equal qualification and standing. If this is your situation it is time to call a Gender Discrimination Attorney.

Civil Rights Act of 1964 comes to Gender Discrimination Defense

U.S Equal Employment Opportunity Commission (EEOC)Title VII of the Civil Rights Act of 1964 prohibits private employers from discriminating on several bases, including race, color, religion, sex, or national origin. For the purposes of this discussion, it is a clear violation of your civil rights for an employer to discriminate on the basis of your gender.

The California Fair Employment and Housing Act (FEHA)

Here, in California, the Fair Employment and Housing Act provides similar protections with some added advantages which we can use to defend your rights in the workplace.
